Gaudifond Arte SL or its affiliated companies are the legal owners of all works of art featured on this website. Each work is guaranteed its:
- Authenticity
- Originality
- No infringement of third-party rights
- Not to be part of the historical heritage of any country.
- Not to be a non-exportable good or of cultural interest.
All material sold on this page benefits from the legal guarantee of conformity and the guarantee against hidden defects, under the following legal conditions:
- Article L.211-4 (Consumer Code): The seller is obliged to deliver goods in conformity with the contract and shall be solely responsible for defects arising during shipment. The seller shall also be liable for defects arising during packaging.
- Article L.211-5 (Consumer Code): To meet the conditions of the contract, the goods must be fit for use and, if not, correspond to the description given by the seller and possess the characteristics that the latter has presented to the consumer in the form of a sample or model and that the consumer has accepted.
- Article 1641 (Civil Code): The seller is responsible for guaranteeing against any hidden defects in the sold item that render it unfit for its intended use, or that significantly diminish such use. Gaudifond Arte SL represents and warrants that this website is technically prepared for the sale of works of art.
Prices of the works
The price of the artworks is set by Gaudifond Arte SL. Prices are in Euros. Any taxes that may arise from the purchase and sale of the artworks are the responsibility of the buyer. Import duties to the destination country are not included in these prices. The price of the artworks may be modified without prior notice.
Purchase of the Work
The user must pay for the artwork at the time of purchase through Shopify or PayPal. Alternatively, payment can be made by bank transfer, in person (by scheduling an appointment at the offices listed at the top of these terms and conditions), or using the cryptocurrencies Bitcoin and Ethereum. The user must provide their postal address to receive shipping costs. The user will receive purchase confirmation from www.gaudifond.com within 24 hours at the email address provided on the order form.
Frames, stands and accessories
The frames, mounts, and accessories accompanying a particular artwork, if any, are period pieces, adapted to the artwork, and are ALWAYS complimentary. Under no circumstances will Gaudifond Arte SL be held responsible for the condition of the frames, mounts, and accessories, nor will any claims, returns, or refunds be accepted regarding them.
Shipment
Gaudifond Arte SL will manage the delivery of the Artwork to the user through Correos de España or a courier service, who are ultimately responsible for the delivery to the address indicated by the user in the purchase form. Gaudifond Arte SL is not responsible for delivery problems arising from erroneous or inaccurate information provided by the user.
The artworks will be shipped with a tracking number, which will be provided to the customer once payment has been made. Graphic works (lithographs, engravings) will be properly packaged in a cardboard tube, unframed. Larger works will be shipped in special packaging depending on their size. The maximum time between purchase confirmation and shipment of the artwork is 14 business days. For these purposes, the artwork will be considered shipped when the postal service or courier company collects it and the customer is notified of the tracking number associated with said artwork. Shipping is free throughout Spain for purchases over €90. A delay in delivery will not be considered to have occurred if the artwork has been held in export or import customs, or if delivery has not been possible due to reasons attributable to the user. Please consult with the authorities of your country regarding import regulations and applicable tariffs. Under no circumstances will Gaudifond Arte SL be responsible for any artwork that may be confiscated by customs in third countries.
In the event that neither Correos (the Spanish postal service), the courier service, nor Gaudifond Arte SL can contact the user to coordinate the delivery of the artwork within a maximum of 14 business days from the first delivery attempt, Correos may return the artwork to Gaudifond Arte SL, with the customer assuming all associated costs (delivery, return, and any other related procedures). Upon delivery, the user must check the condition of the package and report any anomalies detected, either on the delivery note or inside the package, within 48 hours by contacting Gaudifond Arte SL at info@gaudifondarte.com and attaching a photograph as evidence.
Returns
The buyer has fourteen (14) days from receipt of the artwork to return it in the same condition in which it was received and with packaging that ensures its proper protection. Once the artwork has been received and its condition verified, the buyer will be refunded. After the fourteen-day period, no returns will be accepted.

Shopify
Shopify is an e-commerce company headquartered in Ottawa, Canada. If the user chooses Shopify as their payment method, the entire process will be managed by Shopify, so the bank information entered by the buyer will not be visible or stored by Gaudifond Arte SL.
Paypal
PayPal Inc., the parent company of PayPal (Europe) S.à.rl et Cie, SCA, is located in California, USA. If the user chooses PayPal as their purchase option, the entire process will be managed by this company, so the bank information provided by the buyer will not be visible to anyone, including Gaudifond Arte SL staff. The buyer will be subject to the guarantees offered by PayPal at all times, as set out on their website.
Miscellany
Gaudifond Arte SL reserves the right to modify these legal terms and conditions at any time. These modifications will take effect immediately upon appearing on www.gaudifond.com.
